      The Senate Transportation Committee reports favorably and with committee amendments Senate Bill No. 3393.

      As amended and reported, this bill requires the New Jersey Motor Vehicle Commission (MVC) to develop and publish an informational pamphlet (pamphlet) concerning the operation of low-speed electric bicycles and low-speed electric scooters and to provide copies of the pamphlet to each food delivery company operating in the State (food delivery company).  At a minimum, the pamphlet is to include:  (1) information on the current laws and regulations regarding the operation of low-speed electric bicycles and low-speed electric scooters; (2) information on the penalties for failure to follow the current laws and regulations regarding the operation of low-speed electric bicycles and low-speed electric scooters; and (3) a notice of the requirement for each food delivery company to distribute the pamphlet to all individuals who deliver food on behalf of the food delivery company using a low-speed electric bicycle or low-speed electric scooter. 

      The MVC is required to update the pamphlet annually to reflect any updated laws and regulations regarding the operation of low-speed electric bicycles and low-speed electric scooters.  The bill requires the MVC to publish the pamphlet on the commission’s Internet website and to include a translation of the pamphlet from English to at least five languages, including Spanish.  The bill further requires the MVC to distribute to each food delivery company:  (1) two copies of the pamphlet within 60 days of developing the pamphlet; and (2) an updated pamphlet each year. 

      Within 30 days of receiving the pamphlet from the MVC, each food delivery company is required to distribute a copy of the pamphlet to all individuals who deliver food on behalf of the food delivery company using a low-speed electric bicycle or low-speed electric scooter.  Finally, the bill requires a food delivery company to include a copy of the pamphlet in any paperwork given during the application process to a person applying to deliver food using a low-speed electric bicycle or low-speed electric scooter.

COMMITTEE AMENDMENTS:

      The committee amended the bill to:

      (1)  clarify that the pamphlet is to include, at a minimum, information on the current laws and regulations regarding the operation of low-speed electric bicycles and low-speed electric scooters, including, but not limited to, the provisions of N.J.S.A.39:6A-4.8 et al., and information on the penalties for failure to follow the current laws and regulations, in addition to the other information required by the bill;

      (2)  require a food delivery company to include a copy of the pamphlet in any paperwork given during the application process, rather than the hiring process, to a person who applies to the food delivery company to deliver food by means of a low-speed electric bicycle or low-speed electric scooter, rather than to a person who applies for employment with the food delivery company to deliver food by means of a low-speed electric bicycle or low-speed electric scooter;

      (3)  revise the bill’s effective date; and

      (4)  make a technical change.
