      The Senate Law and Public Safety Committee reports favorably and with committee amendments Senate Bill No. 2641.

      As amended and reported by the committee, this bill permits farm brewery licensees to sell products to consumers for consumption on the licensed premises and, as amended, increases the quantity limitation on samples of malt alcoholic beverages.

      Under current law, the holder of a farm brewery license is entitled, subject to rules and regulations, to brew any malt alcoholic beverages in a quantity to be expressed in the license not in excess of 2,500 barrels of 31 fluid gallons per year and to sell products to consumers for consumption off the licensed premises and to offer samples for sampling purposes only.  Current law further provides that sampling means the selling at a nominal charge or the gratuitous offering of an open container not exceeding one and one-half ounces of a malt alcoholic beverage.

      As introduced, the bill allows holders of a farm brewery license to also sell products to consumers for consumption on the licensed premises.  The bill, as amended, also increases the quantity limitation on samples of malt alcoholic beverages offered by farm brewery licensees to four ounces.

      This bill was pre-filed for introduction in the 2025-2026 session pending technical review. As reported, the bill includes the changes required by technical review, which has been performed.

COMMITTEE AMENDMENTS:

      The committee amended the bill to increase the quantity limitation on samples of malt alcoholic beverages permitted to be offered by farm brewery licensees from one and one half ounces to four ounces.
