BILL DESCRIPTION

This bill consolidates the administration of the New Jersey Public Employees' Occupational Safety and Health Act under the Department of Labor and Workforce Development by relocating to that department certain parts of the program which are currently located in the Department of Health.

Under the bill, all powers, functions, and duties of the Department of Health relating to inspection, investigation, and related activities under the New Jersey Public Employees’ Occupational Safety and Health Act are transferred to the Department of Labor and Workforce Development, along with the proportionate share of the resources necessary to maintain these activities.

OFFICE OF LEGISLATIVE SERVICES

The OLS determines that the bill may potentially result in a small indeterminate increase in State expenditures to transfer the administration of the New Jersey Public Employees’ Occupational Safety and Health Act from the Department of Health to the Department of Labor and Workforce Development.  The duties transferred include inspection, investigation, and related activities pursuant to the New Jersey Public Employees’ Occupational Safety and Health Act.  While a proportionate share of resources will accompany the transfer, there is potential for overlapping expenses related to knowledge transfer and training across the two departments during the transition.

Once the transfer of administration is complete, spending should remain consistent with existing State resource requirements, all else being equal.
