Fiscal Impact |

|
State Expenditure Increase |
Indeterminate |
|
|
· The Office of Legislative Services (OLS) finds that the bill would result in an indeterminate annual increase in State expenditures due to additional administrative responsibilities imposed on State agencies. The bill requires State agencies to provide advance written notice before discontinuing, reducing, suspending, or materially changing certain State aid payments or State services.
· The OLS cannot quantify the fiscal impact because it is unknown how many programs or services would be affected each year and whether State agencies would need additional personnel or other administrative resources to comply with the bill’s notice requirements.
BILL DESCRIPTION
This bill requires a State agency to provide advance written notice before discontinuing, reducing, suspending, or materially changing State aid payments or a State service.
With some notable exceptions, the bill requires the State agency to provide the notice at least 60 days before the discontinuance, reduction, suspension, or material change takes effect. If the State aid or State service directly affects public health, safety, or welfare, the bill requires the State agency to provide the notice at least 90 days before the change takes effect.
The bill requires the notice to include certain information, including: a description of the State aid or State service being discontinued, reduced, suspended, or materially changed; the date on which the change will take effect; the reason for the change; a description of any available alternatives or transition assistance; and contact information for additional information or for filing an appeal, if applicable.
The bill also requires State agencies to provide concurrent notice to legislative leadership and relevant committee chairs when discontinuing any State aid or service for which funds were appropriated by the Legislature.
FISCAL ANALYSIS
EXECUTIVE BRANCH
None received.
OFFICE OF LEGISLATIVE SERVICES
The OLS finds that the bill would result in an indeterminate annual increase in State expenditures due to additional administrative responsibilities imposed on State agencies.
The bill requires State agencies to provide advance written notice before discontinuing, reducing, suspending, or materially changing certain State aid payments or State services. Depending on the number of programs and services affected each year, State agencies may incur additional administrative costs associated with preparing the required notices, identifying affected parties, transmitting the notices, publishing or otherwise making the notices available, and responding to related inquiries or appeals.
The OLS cannot determine how frequently State agencies discontinue, reduce, suspend, or materially change State aid or State services; how many persons or entities would be entitled to notice; whether notice would be provided electronically, by mail, through publication, or by some other method; or the extent to which agencies would need to dedicate additional staff time or resources to comply with the bill.
