STATEMENT TO

ASSEMBLY, No. 3318

with Senate Floor Amendments

(Proposed by Senator CORRADO)

ADOPTED: MARCH 23, 2026

These floor amendments:

(1) specify that:

(a) a person aggrieved by the violation may bring a civil action for actual damages not to exceed the total fees collected by the third-party restaurant reservation service; and

(b) a food service establishment may bring a civil action for actual damages as a result of reservations made by the third-party reservation service that remained unfilled; and

(2) make the bill effective immediately.
