STATEMENT TO
SENATE, No. 4928
with Senate Floor Amendments
(Proposed by Senator SARLO)
ADOPTED: DECEMBER 18, 2025
This bill requires payment of the prevailing wage for certain data center construction.
These Senate amendments change references in the bill concerning the designed electrical usage of data center construction projects from measurements in kilowatt-hours to a fixed annual usage measured in megawatts. The amendments also remove requirements that: (1) a contractor provide references demonstrating successful completion of no less than 10 projects of similar scope and value; (2) a contractor have a direct contractual relationship with the general contractor; and (3) all workers employed on data center construction projects undergo a criminal history record background check.
The amendments provide that certain information required to be maintained under the bill is to be made available upon request to the New Jersey Department of Labor and Workforce Development.
The amendments further remove a prohibition on contractors of the third-tier from working on data center construction projects. Finally, the amendments provide that a data center construction project designed to have an annual electrical usage of 25 megawatts or greater after construction may include a project labor agreement with the labor organizations with collective bargaining agreements that are or were the basis for a determination of the prevailing wage under the project.
