SENATE COMMITTEE SUBSTITUTE FOR

SENATE, No. 4509

with Senate Floor Amendments

(Proposed by Senator RUIZ)

ADOPTED: DECEMBER 18, 2025

These floor amendments clarify the Division of Alcoholic Beverage Control’s authority under the bill and change the grace period for certain product sales from 60 days to 90 days.  Thus, effective April 13, 2026, the sale, offer for sale, or distribution of certain products enumerated under the bill will become unlawful. Moreover, prior to April 13, 2026, beverages sold in accordance with the bill will have no THC concentration limit and will not require a certificate of analysis.  After April 13, 2026, intoxicating hemp beverages will be limited to five milligrams per serving, or 10 milligrams of total THC per container.  A certificate of analysis is required to accompany the sale or distribution of such beverages after April 13, 2026.  Finally, the floor amendments make the imposition of the excise fee effective April 13, 2026 instead of April 1, 2026.
