SYNOPSIS
Establishes education requirements for certain officers of State Board of Medical Examiners.

An Act concerning the State Board of Medical Examiners and amending R.S.45:9-2.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. R.S.45:9-2 is amended to read as follows:
45:9-2. The board shall elect a president, a vice president, a secretary, and a treasurer from its membership and shall have a common seal, of which all courts of this State shall take judicial notice. The president and vice president of the board shall possess the degree of M.D., D.O., or D.P.M. [Its] The president, or secretary, may issue subpoenas to compel attendance of witnesses to testify before the board and administer oaths in taking testimony in any matter pertaining to its duties, which subpoenas shall issue under the seal of the board and shall be served in the same manner as subpoenas issued out of the Superior Court of this State. Every person who refuses or neglects to obey the command of such subpoena, or who, after appearing, refuses to be sworn and testify shall, in either event, be liable to a penalty of $50[.00] to be sued for in the name of the board in any court of competent jurisdiction, which penalty when collected shall be paid to the treasurer of said board. [It] The board shall make and adopt all necessary rules, regulations, and bylaws not inconsistent with the laws of the State or of the United States, whereby to perform the duties and to transact the business required under the provisions of this article (section 45:9-1 et seq.).
The board shall charge for licenses and other services performed by it the fees provided in chapter 9 of Title 45 of the Revised Statutes, or where not so provided, such fees as it shall prescribe by rule or regulation. The board shall make such disposition of all fees and moneys collected by it and such reports in connection therewith as directed by the Director of the Division of Budget and Accounting.

2. This act shall take effect on the first day of the fourth month next following the date of enactment.
STATEMENT
This bill amends R.S.45:9-2 to require the State Board of Medical Examiners (the board) to elect a vice president in addition to a president, a secretary, and a treasurer, and requires the president and vice president to be an allopathic physician (M.D.), an osteopathic physician (D.O.), or a doctor of podiatric medicine (D.P.M.).
This bill will take effect on the first day of the fourth month next following the date of enactment to allow the board sufficient time to comply with the new education requirements for its officers.
