SENATE COMMUNITY AND URBAN AFFAIRS COMMITTEE

STATEMENT TO

SENATE, No. 4048

with committee amendments

STATE OF NEW JERSEY

DATED:  JANUARY 30, 2025

The Senate Community and Urban Affairs Committee reports favorably, with committee amendments, Senate Bill No. 4048.

As amended and reported, this bill prohibits a county or municipality, or other approving authority, from approving a site plan submitted pursuant to law, after the date of enactment of the bill, for the construction of a large warehouse on a lot of land within 1,000 feet of a historic district, as the terms “large warehouse” and “historic district” are defined in the bill.  A planning board with jurisdiction over a historic district may waive the provisions of the bill if a developer petitions the planning board for a waiver in a form and manner determined by the planning board.

The bill is to take effect immediately and is to be applicable to proposals to develop a large warehouse for which a construction permit has not been declared complete by the enforcing agency as of the date of enactment.

COMMITTEE AMENDMENTS:

The committee amended the bill to allow a planning board to waive the provisions of the bill if a developer seeks a waiver from the planning board in a form and manner determined by the planning board.
