STATEMENT TO

with Senate Floor Amendments

ADOPTED: JUNE 30, 2025

      This floor amendment updates the bill to:

      (1)  stipulate that nothing in the bill is to be construed as limiting or superseding the authority of the Department of Banking and Insurance to impose additional cost sharing limits consistent with State law and regulations, including minimum standards established in current regulations;

      (2)  update the deadline to March 31 by which each carrier, third party administrator, and pharmacy benefits manager has to certify its compliance with the provisions of the bill to the department;

      (3)  apply certain definitions solely to the section on the annual limitation on cost-sharing amounts provided for in federal law that are applicable to health benefits plans administered by a pharmacy benefits manager;

      (4)  remove provisions addressing the State’s authority to regulate carriers and pharmacy benefits managers; and

      (5)  update the effective date.
