SENATE, No. 3195

with Senate Floor Amendments

(Proposed by Senator SMITH)

ADOPTED: DECEMBER 18, 2025

      These floor amendments would:

      (1)  add language to expressly permit an employee at a food service business to offer single-use utensils and condiments to guests, if the food service business is authorized to provide single-use utensils or condiments pursuant to the bill’s provisions; and

      (2)  modify the penalty amounts for second and subsequent offenses of the bill’s provisions from $1,000 to $100 for the second offense and from $2,500 for the third and subsequent offense to $250; and

      (3)  add language that would modify how penalty amounts are assessed if a food service business does not commit a violation of the bill’s provisions for at least 12 months.
