SENATE, No. 3132
with Assembly Floor Amendments
(Proposed by Assemblywoman SPEIGHT)
ADOPTED: MAY 22, 2025
Senate Bill No. 3132 (3R) imposes certain requirements on secondhand dealers of cellular telephones and wireless communication devices.
These Assembly amendments require secondhand dealers to make available certain records for inspection by the Director of Consumer Affairs in the Department of Law and Public Safety.
Additionally, these Assembly amendments prohibit a secondhand dealer from selling or sharing any information or data regarding any person who sells a cellular telephone or wireless communication device to the dealer without that person’s written consent, and require the secondhand dealer to securely maintain the information and data, in accordance with any rules or regulations that may be established by the director.
The Assembly amendments also allow the Director of the Division of Consumer Affairs in the Department of Law and Public Safety to promulgate rules and regulations to implement the provisions of the bill.
Finally, these Assembly amendments provide that a person who violates the bill’s provisions is subject to a civil penalty that is not more than $250 for a first offense, not more than $500 for a second offense, and not more than $1,000 for a third or subsequent offense, to be collected in a summary proceeding pursuant to the penalty enforcement law.
As introduced, a person who violated the bill’s provisions was subject to a civil penalty of $250 for a first offense, $500 for a second offense, and $1,000 for a third or subsequent offense.
These Assembly amendments make this bill identical to Assembly No. 4334 (1R) which also was amended by the Assembly on this date.
