      The Senate Budget and Appropriations Committee reports favorably and with committee amendments Senate Bill No. 2167 (1R).

      As amended and reported, this bill requires all public and nonpublic schools participating in the National School Lunch Program and the federal School Breakfast Program to comply with federal nutrition standards and competitive foods sold in schools adopted by the United States Department of Agriculture for the National School Lunch Program and federal School Breakfast Program, or any other more stringent nutrition standards adopted at the federal level in the future.

      The bill codifies in State law that all reimbursable meals under the National School Lunch Program and the federal School Breakfast Program are to comply with the current nutrition standards for the National School Lunch Program and federal School Breakfast Program adopted by the United States Department of Agriculture or any other updated nutrition standards adopted at the federal level in the future.

 

COMMITTEE AMENDMENTS:

      The committee amended the bill to:

      (1)  stipulate that the nutrition standards referenced in the bill are the standards adopted by the United States Department of Agriculture in the final rule titled “Child Nutrition Programs: Meal Patterns Consistent with the 2020-2025 Dietary Guidelines for Americans” in 7 C.F.R. Part 210, Part 215, Part 220, Part 225, and Part 226; and

      (2)  change the bill’s effective date so that it first applies to the 2025-2026 school year.
