SENATE COMMERCE COMMITTEE

STATEMENT TO

SENATE, No. 1237

with committee amendments

STATE OF NEW JERSEY

DATED:  FEBRUARY 5, 2024

The Senate Commerce Committee reports favorably and with committee amendments Senate Bill No. 1237.

As amended, this bill updates provisions to reflect changes to the underlying law.  Additionally, it requires a telemarketer, when making or causing to be made any telemarketing sales call, to transmit or cause to be transmitted the telephone number and the name of the telemarketer to any caller identification service in use by a recipient of a telemarketing sales call.  However, it is not a violation of the provisions of the bill to substitute, for the name and telephone number used in or billed for making the call, the name of the seller on behalf of which a telemarketing sales call is placed and the seller’s customer service telephone number that is answered during regular business hours.

This bill was pre-filed for introduction in the 2024-2025 session pending technical review.  As amended and reported, the bill includes the changes required by technical review, which has been performed.

COMMITTEE AMENDMENTS:

The committee amended the bill to reflect changes in the underlying law and to require the transmission of:

      (1)  the telephone number and name of the telemarketer when making or causing to be made a sales call; or

      (2)  the name of the seller on behalf of which the call is being placed.
