ASSEMBLY CONSUMER AFFAIRS COMMITTEE
STATEMENT TO
ASSEMBLY, No. 5922
with committee amendments
STATE OF NEW JERSEY
DATED: DECEMBER 11, 2025
The Assembly Consumer Affairs Committee reports favorably and with committee amendments Assembly Bill No. 5922.
As amended and reported, this bill requires retail establishments to disclose the portion of a product's retail price attributable to tariffs and trade-related import taxes.
Tariffs directly impact retail prices but are rarely visible to the consumer. As trade policies shift, tariffs can become a hidden tax on households. The amended bill requires clear, standardized information available at the point of sale to help consumers make informed purchasing decisions.
The bill requires retail establishments to disclose the percentage or dollar amount of the final price attributable to tariffs on either the price tag, online product pages, or sales receipt. Businesses are required to maintain documentation on the tariff calculations and are subject to periodic compliance audits and fines for noncompliance.
Retail establishments with revenues below $500,000 in annual sales and products whose tariff-related pricing impact is negligible are exempt from the bill.
The bill requires the Director of the Division of Consumer Affairs in the Department of Law and Public Safety to develop regulations to provide the manner in which the tariff portion of a retail price is to be calculated and displayed and establish and modify a list of commodities exempt from the provision of the bill. The bill prohibits the director from exempting consumer commodities or retail establishments from the provisions of the bill except where compliance would be impractical. The bill requires the director to maintain a public, clearly defined list of product exemptions and a list of establishments classes that are required to comply with the bill.
COMMITTEE AMENDMENTS:
The committee amended the definition of “wholesale trade firm” to include a business that resells to other wholesale trade firms. As introduced, the definition only included businesses that resell to retail establishments.
The committee amendments also require that wholesale trade firms that resell to other wholesale trade firms maintain records on tariffs paid and to provide those records to the wholesale trade firms they resell to.
