CURRENT VERSION OF TEXT
As introduced.
An Act concerning the communication of certain statutory and regulatory requirements and supplementing Title 54 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. As used in this act:
“Business” means an individual, partnership, association, joint stock company, trust, corporation, or other legal business entity or successor thereof, but does not include a nonprofit corporation, organization created pursuant to 26 U.S.C. s.501(c)(3), or a government agency.
b. A business required to comply with any business registration requirement of the Division of Revenue and Enterprise Service in the Department of the Treasury or any successor agency, shall have the option to provide, when electronically filing or renewing a registration, an email address to the division, for the purpose of receiving electronic notifications concerning new statutory or regulatory requirements for the business to comply with and information on economic incentives affecting industries in which the business operates. The division shall also provide a method for a business to provide the email address independent of the renewal process through the division’s website or other electronic means as determined by the division.
c. The Division of Revenue and Enterprise Services shall provide the Department of Labor and Workforce Development with the email addresses provided pursuant to subsection b. of this section to allow the Department of Labor and Workforce Development to communicate with and provide notices to businesses.
d. Notwithstanding any law, rule, or regulation to the contrary, a business that accepts the option to receive email notifications, pursuant to subsection b. of this section, shall no longer receive paper or other forms of communication concerning new statutory or regulatory requirements for the business to comply with and information on economic incentives affecting industries in which the business operates.
e. A business may provide notification to the Division of Revenue and Enterprise Services, in a form and manner prescribed by the division, requesting a cessation of email notifications provided pursuant to subsection b. of this section. Upon receipt of this request, the division shall, within 60 calendar days of receiving notification from the business, cease email notifications and resume paper or other forms of communication to the business.
f. The State Treasurer, in consultation with the Commissioner of Labor and Workforce Development, shall adopt rules and regulations pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), to implement the provisions of this act.
2. This act shall take effect on January 1 next following the date of enactment, except that the State Treasurer may take any anticipatory administrative action as shall be necessary for the implementation of this act.
STATEMENT
This bill provides businesses with the option of receiving notifications from the Division of Revenue and Enterprise Services and, as applicable, from the Department of Labor and Workforce Development, on new statutory and regulatory requirements and economic incentives related to their industry.
Current processes require that all businesses registered in the State receive these updates via traditional paper communication. The bill allows any business with the option of providing a registered email address to the Division of Revenue and Enterprise Services, which will coordinate the dissemination of these statutory, regulatory and economic incentive-related communications through the provided email.
The bill also provides a method for businesses to revert to the traditional means of paper communication.
