BILL DESCRIPTION

This bill requires the Superintendent of the Division of State Police to inform local law enforcement in a municipality in which a person resides if that person had previously been convicted of a serious crime or whose firearms were subject to seizure pursuant to a domestic violence restraining order or extreme risk protection order and that person attempts to purchase a firearm.  If the municipality in which the person resides does not have a municipal law enforcement agency, the superintendent would be required inform the appropriate commanding law enforcement officer with jurisdiction over the municipality.

Under the bill, if a National Instant Criminal Background Check System reveals that a person convicted of one of these crimes attempted to purchase a firearm, the superintendent would notify a law enforcement agency having jurisdiction over that person.

FISCAL ANALYSIS

EXECUTIVE BRANCH

A representative in the Office of the Attorney General informally verified that the New Jersey Division of State Police’s Firearms Investigation Unit currently adheres to this process.  It was indicated that every National Instant Criminal Background Check System denial is reviewed by the Firearms Investigation Unit, and an informational package regarding the denial is sent to the police department that approved the resident’s Firearm Purchaser Identification Card or permit to purchase a handgun.  The law enforcement agency with jurisdiction is then responsible for conducting an investigation to determine the next steps.
