STATEMENT TO

ASSEMBLY, No. 4436

STATE OF NEW JERSEY

DATED:  MARCH 17, 2025

The Senate Community and Urban Affairs Committee reports favorably Assembly Bill No. 4436.

This bill requires construction contracts entered into under the "Local Public Contracts Law" to allow the contractor to pay enforcing agency fees imposed under the "State Uniform Construction Code" by way of a card payment system or electronic funds transfer system.

Under the bill, a local unit is required to establish a card payment system and electronic funds transfer system for payments required to be made under the "State Uniform Construction Code Act," P.L.1975, c.217 (C.52:27D-119 et seq.).  A local unit is required to establish a card payment system or electronic funds transfer system by passage of a resolution of the governing body.

As reported by the committee, Assembly Bill No. 4436 is identical to Senate Bill No. 3323, which was also reported by the committee on this date.
