BILL DESCRIPTION
This bill would require pest inspections prior to certain demolitions. The bill would require a building to obtain a certification, which would indicate whether the building contains a pest infestation that places any closely-situated building at risk for infestation, prior to being issued a construction permit for demolition. The certificate would be issued by a local health officer, an employee of a local health agency, or a commercial pesticide applicator certified by the Department of Environmental Protection. The individual issuing a certification would be required to, no earlier than 60 days before the issuance of a construction permit, inspect the building for pest presence and, in the case where a severe pest presence exists, mitigate the pest presence to acceptable levels. The bill provides exceptions to the certification and mitigation requirements, including the demolition of a building: (1) that has no closely-situated buildings; or (2) that the construction official determines is structurally unsafe, posing an immediate danger. The bill would make the permit applicant responsible for the cost of the inspection and certification required by the bill.
A certificate issued by a pesticide applicator certified by the Department of Environmental Protection would be filed with the local health officer and the construction official no later than five days before the issuance of the construction permit. At any time prior to the issuance of a construction permit, the local health officer may disapprove of the pesticide applicator’s certification and require a new inspection.
The bill directs the Commissioner of Environmental Protection, in consultation with the Commissioner of Health and the Director of the Division of Codes and Standards in the Department of Community Affairs, to adopt rules and regulations to implement the provisions of the bill. The bill additionally authorizes the Commissioner of Health and the Director of the Division of Codes and Standards, to adopt rules and regulations to implement the provisions of the bill.
