SYNOPSIS
Appropriates unexpended funds from “1999 Statewide Transportation and Local Bridge Fund.”

An Act concerning the improvement of the State transportation system and bridges and making an appropriation.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. Notwithstanding any provision of law to the contrary, any remaining unexpended funds from the “Statewide Transportation and Local Bridge Bond Act of 1999,” P.L.1999, c.181, which were appropriated pursuant to section 3 of P.L.2000, c.155 and section 3 of P.L.2001, c.239 shall be reappropriated the Department of Transportation and made available for the purposes set forth in subsection b. of this section.
b. The funds reappropriated pursuant to this section shall be administered by the Department of Transportation to offset any cost, eligible under the provisions of P.L.1999, c.181 for transportation projects, to be allocated at the discretion of the Commissioner of Transportation.
2. a. Notwithstanding any provision of law to the contrary, any remaining unexpended funds from the “Statewide Transportation and Local Bridge Bond Act of 1999,” P.L.1999, c.181, which were appropriated pursuant to section 2 of P.L.2000, c.11, section 2 of P.L.2000, c.155, or section 2 of P.L.2001, c.239 shall be reappropriated to the Department of Transportation and made available for the purposes set forth in subsection b. of this section.
b. The funds reappropriated pursuant to this section shall be administered by the Department of Transportation to offset any cost, eligible under the provisions of P.L.1999, c.181, for the rehabilitation and improvement of structurally deficient bridges carrying county and municipal roads, but only within the county to which such funds were previously appropriated.
c. Any funds appropriated pursuant to the provisions of this section that are not expended or obligated within two years of the effective date of this act shall be consolidated into a single account and redistributed to each county in this State on a formula basis, to be established by the Department of Transportation, for the rehabilitation and improvement of structurally deficient bridges carrying county or municipal roads. Funds that have not been obligated, but are required to complete a project under development, shall be subject to consolidation and redistribution.
3. This act shall take
effect immediately.
STATEMENT
This bill reappropriates unexpended funds from the “Statewide Transportation and Local Bridge Bond Act of 1999” (act) to the Department of Transportation (department) that were originally appropriated for the purpose of: (1) financing the costs of transportation projects; and (2) providing grants to county and municipal governments for the costs to rehabilitate and improve certain structurally deficient bridges.
The bill provides that the funds appropriated to the department, which were originally appropriated to provide grants to county and municipal governments for the costs to rehabilitate and improve certain structurally deficient bridges, are to be administered by the department to offset any eligible cost to rehabilitate and improve certain structurally deficient bridges, but only within the county to which the funds were previously appropriated.
Additionally, the bill provides that the funds appropriated to rehabilitate and improve certain structurally deficient bridges that are not expended or obligated within two years of the bill’s effective date are to be consolidated into a single account and redistributed to each county based on a formula established by the department. Under the bill, funds that have not been obligated, but are required to complete a project under development are subject to consolidation and redistribution.
