SENATE, No. 332

with Senate Floor Amendments

(Proposed by Senator SINGLETON)

ADOPTED: DECEMBER 19, 2022

These floor amendments remove individuals acting within a job-seeking context from the definition of “consumer.”  The amendments provide that personally identifiable information may be disclosed orally by adding “oral” to the definition of “disclose.”  Additionally, the amendments provide that publically available information is included in the definition of personally identifiable information and add a definition of “publically available information” to the bill.  The amendments also remove language that includes third parties that track or collect information concerning a customer’s usage of a commercial Internet website from the definition of “operator.”

The amendments remove the process for a consumer who uses or visits a commercial Internet website or online service to review and request changes to the consumer’s personally identifiable information that is collected by the operator and correct a cross-reference to another section in the bill.
