An Act 1[establishing a three-year Crisis Response Support] concerning the ARRIVE Together Crisis Response1 Pilot Program and making an appropriation.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  As used in this section:

     “Pilot county” means a county in which a municipality has been selected by the 1[Commissioner of Health] Attorney General1 to participate in the pilot program 1expansion1 established pursuant to 1subsection c. of1 this section.

     “Pilot municipality” means a municipality selected by the 1[Commissioner of Health] Attorney General1 to participate in the pilot program 1expansion1 established by 1subsection c.1 this section.

     “Pilot program 1expansion1” means the 1[Crisis Response Support] expansion of the Alternative Response to Reduce Instances of Violence and Escalation (ARRIVE) Together1 Pilot Program established by 1subsection c. of1 this section.

     b.  1[There is established a three-year Crisis Response Support Pilot Program.  The purpose of the] The Attorney General shall establish a1 pilot program 1[shall] to1 be 1known as the Alternative Response to Reduce Instances of Violence and Escalation (ARRIVE) Together Pilot Program. The program shall be designed1 to provide 1accessible crisis intervention, mental health screening, or other1 support to 1[police departments or forces in the State when responding to a call that involves a person who is suffering from a mental health condition or substance use disorder and is in] individuals experiencing mental health1 crisis 1who have contacted or are engaging with law enforcement.

     Following the establishment of the program, the Attorney General shall effectuate a pilot program expansion as provided in subsection c. of this section1.

     c.     1[The Commissioner of Health] Within the limits of available funds provided pursuant to section 2 of P.L.   , c   (C.    ) (pending before the Legislature as this bill), the Attorney General1 shall select for participation in the pilot program 1expansion1 two municipalities in each of the northern, central, and southern regions of the State 1[, as follows:

     (1) a northern regional pilot municipality shall be located in Essex County in a municipality having a population of more than 30,000 and a population density of more than 10,000 persons per square mile according to the latest federal decennial census;

     (2) a central regional pilot municipality shall be located in Middlesex County in a municipality having a population of more than 35,000 and a population density of more than 7,500 persons per square mile according to the latest federal decennial census;

     (3) a southern regional pilot municipality shall be located in Burlington County in a municipality having a population of more than 7,000 and a population density of more than 4,750 persons per square mile according to the latest federal decennial census], the selection of which shall not exclude participation by other counties or municipalities in the pilot program1.

     d.    The county prosecutor's office in each pilot county shall designate a crisis response support coordinator who shall be responsible for coordinating with the 1[Commissioner of Health] Attorney General1 to develop procedures 1[for implementing the Crisis Response Support Pilot Program in each pilot municipality] consistent with the guidelines established pursuant to subsection f. of this section1.

     e.     1[Each pilot municipality or pilot county shall contract with a nonprofit] Consistent with the guidelines developed pursuant to subsection f. of this section, one or more1 mental health service 1[provider] providers shall be contracted1 to provide 1[support] services as needed1 to the 1State Police or the1 police department or force1, as appropriate,1 in the pilot municipality when responding to a call that involves a person who is 1[suffering from] experiencing1 a mental health 1[condition]1 or substance use 1[disorder and is in]1 crisis.  The provider shall 1[be contracted to]1 provide 1[support] services as needed for up to1 24 hours a day, seven days a week.  1[The pilot municipality or pilot county shall provide information concerning the mental health service provider to the appropriate county crisis response support coordinator.]1

     f.     The [Commissioner of Health, in consultation with the county crisis response support coordinators,] Attorney General shall establish guidelines for the implementation of the pilot program 1[in each pilot municipality] expansion1.

     g.    1[The] To the extent applicable and consistent with the guidelines established pursuant to subsection f. of this section, the1 governing body of a pilot municipality or pilot county shall provide documentation 1[of the costs incurred to implement the Crisis Response Support Pilot Program] or information1 to the 1[Commissioner of Health. The Department of Health shall reimburse each pilot municipality or pilot county for the documented costs associated with implementing the pilot program] Attorney General1.

     h.    The 1[Commissioner of Health] Attorney General1 shall 1[submit] cause to be transmitted1 a report evaluating the implementation and operation of the pilot program 1expansion1 to the Governor and, pursuant to the provisions of section 2 of P.L.1991, c.164 (C.52:14-19.1), to the Legislature within 90 days after the completion of the pilot program 1expansion1. The report shall recommend whether the pilot program 1expansion1 should be continued, 1[expanded] modified1, or made permanent.

 

     2.    There is appropriated from the General Fund to the Department of 1[Health] Law and Public Safety1 the sum of $2,000,000 to effectuate the provisions of section 1 of P.L.     c.    (C.        ) (pending before the Legislature as this bill).  The 1[Commissioner of Health] Attorney General and any other department, as appropriate,1 may seek assistance from the federal government, private foundations, and any other source to fund the 1[Crisis Response Support]1 Pilot Program 1expansion1 established pursuant to section 1 of P.L.     , c.    (C.        ) (pending before the Legislature as this bill).

 

     3.    This act shall take effect on the first day of the 1[seventh] eleventh1 month next following the date of enactment and shall expire upon the filing of the report required pursuant to subsection h. of section 1 of P.L.    , c.    (C.        ) (pending before the Legislature as this bill). The 1[Commissioner of Health] Attorney General1 may take any anticipatory administrative action in advance of the effective date as shall be necessary for the implementation of this act.
