ASSEMBLY CONCURRENT RESOLUTION No. 166

 

with committee amendments

      The Senate Judiciary Committee reports favorably and with committee amendments Assembly Concurrent Resolution No. 166 (1R).

     As amended, this concurrent resolution revises the Legislative Code of Ethics to remove the requirement that legislators disclose the address and description of their principal or secondary residences in annual financial disclosure statements.  Instead, legislators would only be required to disclose the address with a brief description, including the county and municipality, (1) of any other real property in which the legislators, their spouses, or their minor children held an interest, or (2) from which they derived income, even if they resided in the income-generating property for any period of time during the preceding year.

     Because the annual statement would no longer include legislators’ residences, legislators would be required to certify that they reside in the legislative district they represent.

     The resolution would take effect immediately and apply to financial disclosure statements filed in 2023 and thereafter.

     This resolution, as amended and reported by the committee, is identical to Senate Concurrent Resolution No. 132, also amended and reported today by the committee.

 

     THE COMMITTEE AMENDMENTS:

     - require legislators to certify that they live in the legislative districts they represent;

     - provide that legislators are not required to disclose the address, municipality, county, or give a brief description of their primary or secondary residence; and

     - mandate disclosure by legislators of any real property, including the address and a brief description, including the county and municipality where located, from which the legislators, their spouses, or their minor children have derived income, including any such property where they resided for any period of time in the preceding year.
