SYNOPSIS

     Requires certain parking lots to have minimum two percent of total spaces designated for individuals with children.

An Act concerning parking spaces for individuals with children in certain parking lots and supplementing chapter 4 of Title 39 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  A person owning or controlling a shopping center or grocery store parking lot containing more than 100 off-street parking spaces and that is open to the public or to which the public is invited shall dedicate parking spaces for individuals with children not more than 12 years of age.

     b.    A minimum of two percent of the total number of parking spaces in a parking lot described in a subsection a. of this section shall be designated for individuals with children.  Parking spots designated pursuant to this subsection shall be located in an area of the parking lot that is most accessible and proximate to the shopping center or grocery store, as determined by the property owner, provided that the parking spaces for individuals with children shall not be closer or more proximate to the shopping center or grocery store than any parking spaces designated for use by handicapped persons.

     c.     Each parking space designated pursuant to subsection b. of this section shall be identified with a clearly visible sign that shall be in a form determined by the Chief Administrator of the Motor Vehicle Commission and shall be distinct from any signage designating a parking space for use by handicapped persons.

     d.    An individual shall not park a vehicle in a parking space designated for individuals with children unless the individual is accompanied by a child not more than 12 years of age.

 

     2.    The Chief Administrator of the Motor Vehicle Commission shall promulgate rules and regulations pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.) to effectuate the purposes of P.L.     , c.    (C.        ) (pending before the Legislature as this bill), which shall include establishing a fine for individuals who violate the provisions of subsection d. of section 1 of P.L.     , c.    (C.        ) (pending before the Legislature as this bill).

 

     3.    This act shall take effect on the first day of the sixth month next following enactment.

 

 

STATEMENT

 

     This bill provides that a person owning or controlling a shopping center or grocery store parking lot with more than 100 off-street parking spaces and that is open to the public or to which the public is invited is to dedicate parking spaces for individuals who are parking with children not more than 12 years of age.

     The bill provides that a minimum of two percent of the total number of parking spaces in those parking lots are to be designated for individuals with children, in an area of the parking lot that is most accessible and proximate to the shopping center or grocery store, as specified in the bill.

     Each parking space designated for individuals with children pursuant to the bill is to be identified with a clearly visible sign that is to be in a form determined by the Chief Administrator of the Motor Vehicle Commission and is to be distinct from any signage designating a parking space for use by handicapped persons.

     The bill provides that an individual is not to park a vehicle in a parking space designated for individuals with children unless the individual is accompanied by a child not more than 12 years of age.

     The bill directs the Chief Administrator of the Motor Vehicle Commission to promulgate rules and regulations concerning the designation of parking spaces pursuant to the bill, which is to include establishing a fine for individuals who violate the provisions of the bill.
