SYNOPSIS

     Authorizes use of digital license plates.

An Act concerning digital license plates and supplementing Title 39 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  For the purposes of this section:

     “Commission” means the New Jersey Motor Vehicle Commission.

     “Digital license plate” means a digital image displayed on a digital license plate device that displays the registration number of a motor vehicle, any other information required by the commission, and any other images or information permitted by the commission, including but not limited to emergency service alerts and personalized messages.

     “Digital license plate device” means an electronic device capable of being mounted to a motor vehicle in accordance with the requirements of motor vehicle license plates and capable of displaying the digital image of a digital license plate.

     b.  Notwithstanding the provisions of any other law to the contrary, the Chief Administrator of the New Jersey Motor Vehicle Commission may permit the use of digital license plates and digital license plate devices in accordance with this section upon application by the owner of a motor vehicle registered in this State.

     c.  All digital license plates and digital license plate devices authorized for use pursuant to this section shall display at all times the registration number issued by the commission for the applicable motor vehicle.

     d.  Personally identifiable information stored on the digital license plate shall be limited to that which is necessary for the commission to approve the use of such devices and that which is necessary for the manufacturer or vendor to provide services to the owner of a motor vehicle, which standards shall be determined by the commission and adopted pursuant to rule or regulation.

     e.  Use of the digital license plate and digital license plate device shall remain optional and users may affirmatively opt in to using the digital license plate and digital license plate device in place of a conventional license plate issued by the commission.

     f.  The commission shall establish standards for the use of digital license plates and digital license plate devices, including but not limited to protocols for data sharing, privacy, and security.  Digital license plates shall only be displayed on digital license plate devices approved by the commission.

     g.  The commission may authorize the sale or resale of digital license plate devices by the device manufacturer or through participating retailers, subject to review and approval by the commission.  The commission shall not charge any additional fee for the use of digital license plates or digital license plate devices in excess of the fee charged for the registration of a motor vehicle. 

     h.  The commission shall promulgate rules and regulations, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), to govern the issuance and use of digital license plates and accompanying digital license plate devices and to otherwise effectuate the purposes of this act.

 

     2.  This act shall take effect on the first day of the seventh month following enactment, except that the New Jersey Motor Vehicle Commission may take anticipatory actions in advance thereof to effectuate the purposes of this act.

 

 

STATEMENT

 

     This bill authorizes the New Jersey Motor Vehicle Commission (commission) to permit the use of digital license plates and digital license plate devices.  Digital license plates authorized for use by the bill are required to, at all times, display the registration number of the motor vehicle.  The commission is required to establish standards for digital license plates and digital license plate devices.
