ASSEMBLY TRANSPORTATION AND INDEPENDENT AUTHORITIES COMMITTEE

STATEMENT TO

ASSEMBLY, No. 189

with committee amendments

STATE OF NEW JERSEY

DATED:  JANUARY 19, 2023

The Assembly Transportation and Independent Authorities Committee reports favorably and with committee amendments Assembly Bill No. 189.

As amended and reported, this bill directs the lead agency of the New Jersey E-ZPass Group to notify customers or prospective customers, on certain websites, that discounts on toll rates advertised by an operator of an E-ZPass system that is not under the jurisdiction of the State or one of its agencies, authorities, or political subdivisions may not be available for New Jersey E-ZPass accounts.

The bill defines “lead agency of the New Jersey E-ZPass Group” or “lead agency” as an agency, authority, or political subdivision of this State which has the authority to enter into, manage, or negotiate contracts to provide service to accounts with New Jersey E-ZPass. Currently, the lead agency of the New Jersey E-ZPass Group is the New Jersey Turnpike Authority.

As amended and reported, Assembly Bill No. 189 is identical to Senate Bill No. 743 (1R), which was reported by the committee on this date.

This bill was pre-filed for introduction in the 2022-2023 session pending technical review.  As reported, the bill includes the changes required by technical review, which has been performed.

COMMITTEE AMENDMENTS:

The committee amendments require the lead agency of the New Jersey E-ZPass Group to provide information regarding E-ZPass on its Internet website, rather than on every publicly accessible webpage of a website in which the lead agency provides information concerning certain E-ZPass information.
